Neighbourhood Planning: Kelham & Neepsend Area & Forum applications

Overview

Under the Localism Act 2011, local communities can produce a Neighbourhood Development Plan setting out policies on the development and use of land in their area.

Community groups and Parish Councils can apply for the designation of a Neighbourhood Plan Area: this is the first stage in producing a Neighbourhood Plan.

In those parts of Sheffield not covered by a Town or Parish Council a Neighbourhood Forum must be designated by the Council in order to produce a Neighbourhood Plan for the Neighbourhood Area. Once a neighbourhood forum has been designated another cannot be designated for the area until that existing neighbourhood forum expires or is withdrawn.

Under The Neighbourhood Planning (General) Regulations 2012 (as amended) the Council has received:

(a) an application from the prospective Kelham Island & Neepsend Neighbourhood Forum to designate a Neighbourhood Area for the purposes of preparing a Neighbourhood Plan; and

(b) an application for the Kelham Island & Neepsend Neighbourhood Forum to be designated as the Neighbourhood Planning Forum for this proposed Neighbourhood Area.

 

 

Why We Are Consulting

In line with the requirements of the Neighbourhood Planning (General) Regulations 2012 (as amended), the Council is required to publicise valid Neighbourhood Area applications and valid Neighbourhood Planning Forum applications for a 6 week period.

The Council is now seeking comments on a) the application for a Neighbourhood Area designation and b) the application to designate a Neighbourhood Forum.

The area application includes a map of the neighbourhood area proposed boundary and a statement on why the area is considered appropriate.

The forum application includes a statement to demonstrate that the applicants are capable of being a qualifying body (within the terms of S61F(5) of the Town & Country Planning Act 1990 as amended), a copy of the forum constitution, and contact details for the forum.

How to comment

Comments on the applications are invited for a 6 week period from Wednesday 28 November 2018 to 9 January 2019.

We will not publish your signature or any of your other personal contact details (such as your address, email address or telephone number).  However, your name (and the name of any relevant organisations) may be published alongside the information that you provide.

We will store any information that you provide us with electronically on a secure Council system.

The Planning Service will not pass any of your personal data onto third parties.

Data will be held by the Council for as long as is necessary for the Council to fulfil its statutory functions regarding the Neighbourhood Planning process.

Regulations 6 & 7 of the The Neighbourhood Planning (General) Regulations 2012 require that we publicise an application for a Neighbourhood Area and/or Neighbourhood Forum on our website and in any other manner likely to bring the applications to the attention of people who live, work or carry on business in the area of the application, and require us to include details on how to make representations on the applications.

Use of contact details

Our adopted Statement of Community Involvement details how we will consult on Planning Policy documents, this includes those parts of the Neighbourhood Planning process where we are required to publicise and receive representations. We will only use contact details attached to representations for purposes in relation to the neighbourhood plan process, including:

  • to seek clarification of comments made by you.
  • to notify you of a decision (where you have asked us to notify you in accordance with Regulation 19 of the Neighbourhood Planning Regulations 2012).
